This Privacy Policy sets out the basis on which information collected from the users or provided by the users is processed by us, [TOUR ASSISTANCE INDIA], a company incorporated under the laws of India and having its registered office at [SA 6/186-91-1A, Sri Nagar Colony, Paharia, Varanasi-221007 Uttar Pradesh (hereinafter referred to as the “Company”), which operates various websites, apps, newsletters and other services including but not limited to delivery of information and content via any mobile or internet connected device or otherwise (collectively the “Service(s)”) .

Capitalized terms which have been used here but are undefined shall have the same meaning as attributed to them in the Terms of Use. The Company respects the privacy of the users of the Services and is committed to protect it in all respects.

        You may choose to purchase any subscription or paid Service using a credit card, e-wallet, or any other electronic payment system. When you chose any subscription / Service/Product, we or our payment system provider may collect your purchase, address, or billing information. However, when you order using an in-app purchase option, same are handled by such platform providers. Typically, the Payment information is provided directly by users, via the Website, into the PCI/DSS-compliant payment processing service to which the Company subscribes, and the Company does not, itself, process or store the Payment Information, except as stated herein.

        The subscriptions/ Services/ Packages may be on auto renewal mode unless cancelled. If at any point you do not wish to auto-renew your subscription, you may cancel your subscription before the end of the subscription term.

        This Payment Information is used to provide you your requested Services, to manage your account, to communicate with you, and enforce any terms of service or agreement related to the Website. We use any Payment Information we acquire from you only to fulfil your order.

  • Prior booking is mandatory. All activities must be paid for in full at the time of booking.
  • These Terms will become binding on You, and Us when booking through the website we issue a confirmation of a booking by invoice.
  • We will assign a booking reference number to the booking and notify you of this when the booking is confirmed. Please quote the booking reference number in all subsequent correspondence with us relating to the booking.
  • If activities/rides are booked on behalf of other participants, you accept the Terms on behalf of each participant/guest and will ensure that the Terms are complied with by each participant in the group.
  • Every time you make a Booking on Our Website, the terms, and conditions applicable at the time of your Booking will apply between Tour Assistance India and You.
  • After reaching the destination for the activity no changes can be made in the activity.
  • Do not compare your bookings with others as everyone gets offers as per company policy from time to time.

Customer Behaviour

  • Drugs are strictly forbidden on Site and participants must not be under the influence of any drugs during an Activity.
  • Participants should not consume alcohol before commencing any activity.
  • We reserve the right, always to act reasonably, in our sole discretion, to cancel a booking, ban entry to the activity venue, or remove from the ride activity without the right to a refund, any person whose presence or behaviour may cause some harm. Affect the enjoyment and/or safety of other customers or employees, or which: uses violent, aggressive, threatening, abusive, discriminatory, or insulting words or behaviour or in any way behaves in a manner that may provoke a breach of the peace.

RIDE ADVENTURE ACTIVITY

  • Adults/Participants here are above the age group of 10 years.
  • Carry additional pairs of clothes during any water-related activity.
  • Please follow the guidelines given by the trainers and instructors.
  • We may have to cancel or reschedule an activity due to some circumstances that may be outside our control. We will contact you as soon as possible if this happens.
  • People who have health problems such as heart surgeries, blood pressure fluctuations, asthma, or recent injuries are advised to consent to a physician before booking.
  • Pregnant women Should avoid.
  • For some adventure activities we will need your consent in writing.

PAYMENT

  • Your Activity can be confirmed after full payment is received.
  • You can pay for the Activity online using a debit card or credit card. If you pay through an agent you can pay by cash, debit card, or credit card.

Booking

  • All bookings made through Taindia.in are subject to availability.
  • By making a booking, you agree to abide by the terms and conditions set forth by the service provider.
  • Booking confirmation will be provided via email or SMS upon successful completion of payment.

JEWELLERY/GLASSES/GOGGLES

  • We recommend all jewelry and watches be removed for all adventure ride activities.
  • No glasses or goggles should be worn during any activity. We do not recommend this, but prescription glasses can be worn if necessary.
  • We are not responsible for any items lost in the river.

GOVERNING LAW

All disputes arising out of adventure activity shall be subject to the exclusive jurisdiction of courts at Varanasi, where the arbitrator would be appointed by the company itself.

ACCEPTANCE OF RISKS AND RESPONSIBILITY

I am aware that participating in this adventure activity involves risks that may result in serious physical, mental, or emotional injury or trauma, paralysis, death, drowning, illness, and disease or damage to myself. I expressly agree to all the risks present in adventure riding. My participation in this adventure riding activity is completely voluntary, no one is forcing me to participate, and I have chosen to participate despite the risks. I fully understand that I may choose not to participate in any given activity at any time during the adventure ride.

LIABILITY RELEASE AND DISCHARGE

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the company Tour Assistance India from any liability, claims, demands, or causes of action that may be in any way connected with my participation in this adventure riding activity, including all such claims which allege negligent acts or omissions of the company.
